Liability and Assumption of Risk for Workshop.

You must read and agree to this in order to participate in Workshops with

The Brantford Lapidary and Mineral Club.

Assumption of Risks

I acknowledge that I have been made aware of the potential risks and dangers associated with attending and participating in lapidary and class activities at The Brantford Lapidary and Mineral Society (BLMS) lapidary workshop. To minimize these risks the use of appropriate clothing, personal protective equipment, lapidary equipment, hand tools, and/or material/chemicals as well as behaviours will be required.

I understand, acknowledge, appreciate, and agree that when participating in lapidary and class activities at the aforementioned lapidary workshop:

1)            I will take responsibility and reasonable care for my own health & safety, including that of any minor children accompanying me.

2)            I am aware that injuries could arise when attending and participating in lapidary and class activities at the aforementioned lapidary workshop, which may include minor, severe, and serious physical and emotional injury/illness to myself and/or any minor children accompanying me.

Health and safety affirmations

3)            I will follow the club-established age limits and guidelines for any minor children accompanying me.

4)            I will follow all health & safety rules and instructions as required by the site owner, the club, and the lapidary workshop leader(s), including that I am aware of:

i)             where the first aid kit is located;

ii)            where the list of emergency numbers is located;

iii)           where baking soda is located (neutralizes acid spills);

iv)           where either running water and/or the eyewash station is located;

v)            where the fire extinguisher(s) is located; and

vi)           where the fire exits are located.

5)            In consideration of the hazardous waste disposal guidelines, I am aware of:

i)             where I am to dispose of oily rags;

ii)            where I am to dispose of sludge from water-cooled machinery; and

iii)           where I am to dispose of sludge from oil-cooled machinery.

6)            I will ensure that myself and/or any minor children accompanying me are trained to use lapidary equipment, hand tools, and/or material/chemicals safely; and will not use any equipment, hand tools, and/or material/chemicals that I am not trained on.

7)            I will clean up my work area and lapidary equipment, hand tools, and/or material used and clean up any chemical spills.

8)            I will inform the lapidary workshop leader(s) of any medical condition(s) that may affect my ability to participate in the aforementioned lapidary workshop, including any medication that may cause drowsiness.

9)            I will inform the lapidary workshop leaders of behaviour(s) and/or condition(s) that might endanger myself and/or others, including any equipment that isn’t working and/or needs replacement.

Safe personal protective equipment and clothing affirmations

10)         I will wear any personal protective equipment as well as any appropriate clothing as required by the club, and the lapidary workshop and class leader(s).

i)             eye safety – safety glasses are considered a must and will be provided by the club if needed;

ii)            hand safety – gloves protect hands against rough rock sharp edges and rubber gloves protect hands when using pickle baths or etching acids;

iii)           hand safety – careful handling of rock material when using lapidary grinders, polishers, and similar equipment to avoid “grinding burns” (wearing gloves, in this case, may be dangerous); 

iv)           dust masks protect against airborne rock dust when rocks are not cooled by water or oil and will be made available by the club;

v)            hearing protection – should be used when using lapidary equipment and saws and will be provided by the club if needed;

vi)           face safety – face guards protect when using toxic chemicals that may splash, volatilize, and/or vaporize;

vii)          rotating equipment safety – clothing should be snug fitting, apron strings should be short, long hair should be tied back, and necklaces and rings should be removed (if rings cannot be removed then should be covered with tape) as all can get caught in rotating equipment;

viii)         some clothing material can pose fire or chemical hazards such as fleece, silk, or polyester (cotton and denim are considered more ideal) and some jewellery can react to chemicals; and

ix)           footwear should cover the entire foot, not slip off the foot, and be flat-heeled.

 

Additional inherent risks affirmations

Additional inherent risks when attending and participating in in lapidary an class activities at the aforementioned lapidary workshop, but are not limited to the following:

 

Food & beverage plus hand, skin, & eye safety affirmations

11)         I am aware that some mineral specimens and rock dust can be poisonous and/or abrasive; therefore, I will not ingest food and beverages in the aforementioned lapidary workshop if there is airborne rock dust; I will clean contaminated work surfaces; and ensure that I wash my hands before and after eating;

12)         I am aware that rock dust and debris should be cleaned up from my clothing and myself or any minor children accompanying me before removing protective eyewear. Additionally, I am aware that:

i)             I should not rub eyes or skin with dirty hands or clothing; and

ii)            I should, as soon as safe to do so, wash glasses or goggles, gloves, hands, and face as soon as possible.

 

Lapidary equipment safety affirmations

12)         I am aware that guards on equipment (in particular, equipment that has belts, pulleys, shafts, or other drive mechanisms) should be used at all times.

13)         I am aware that I am required to monitor, when using such equipment, coolant amounts (used to cool the rock, blade, or wheels); and will inform workshop leader(s) if coolant levels are low

14)         I am aware that I will inform workshop leader(s) if rotating equipment has excessively worn wheels, disks, etc.

 

Silversmithing & metal working safety affirmations

15)         I am aware of where the Workplace Hazard Material Information System (WHMIS) information sheets (hazardous materials) in the aforementioned lapidary workshop are stored and/or posted.

16)         I am aware of the safe use of flux;

i)             I am aware that I should use water in an appropriate container to quench/cool my piece after heating; and

ii)            I am aware that I will need to immediately clean/wash my hands, tools, and any surfaces if in contact with flux solution.

17)         I am aware of the safe use of pickle (sodium bisulphate – acid used to remove oxides, flux, and oil from metal);

i)             I am aware that, when using pickle, I should wear safety glasses, wear a safety mask to protect from pickle fumes, wear protective gloves (usually rubber), and use only appropriate handling tongs (no metal tongs)

ii)            I am aware that cleanup of pickle is done with water (rinse) and baking soda (neutralizes the acid); and if in contact with eyes, ensure that I will seek medical help.

18)         I am aware of the safe use of a propane torch – when lighting, during use, and closing the torch.

I, the undersigned, wish to attend and participate, voluntarily, in Brantford Lapidary and Mineral Society (BLMS) lapidary activities and other classes at the lapidary workshop located at 643 Governors Rd East Unit #1 Paris Ontario.

 

Liability Waiver

In consideration of the permission granted to me by the Central Canadian Federation of Mineralogical Societies (CCFMS), the Brantford Lapidary and Mineral Society (BLMS), and Martin Farming, the property owner.

I agree to and hereby assume all risk of all and any injuries to myself, and/or any minor children accompanying me; and damage or loss of my property or property belonging to any minor children accompanying me, while attending and participating in any lapidary activities at the aforesaid lapidary workshop.

 

In case of emergency affirmation

I understand, acknowledge, and agree that while attending and participating at the lapidary workshop and/or during any lapidary activities, if I and/or any minor children accompanying me become injured:

i)             I grant permission for first aid and/or CPR to be performed, including the use of Automated Electronic Defibrillators (AED)s;

ii)            I authorize the sharing of medical information with medical personnel; and

iii)           I authorize, and will assume the costs of, emergency transport, if required.

 

Indemnification

I agree to indemnify and hold harmless on behalf of myself, my family and next of kin, personal representatives, assigns, executors, administrators, successors, and heirs the Central Canadian Federation of Mineralogical Societies (CCFMS), the Brantford Lapidary and Mineral Society (BLMS), and Martin Farming (site owner) including their board/council members, representatives, agents, servants, and successors, for all manner of actions, suits, demands, and claims whatsoever in connection with all and any injuries to myself, and/or any minor children accompanying me; and damage or loss of my property or property belonging to any minor children accompanying me while attending and participating in any lapidary activities at the aforesaid lapidary workshop; and which takes place on the date of my signature on the accompanying SISO (sign-in/sign-out sheet).

This agreement shall be binding on my heirs, executors, and administrators.

 

 

 

I acknowledge that I have carefully read the entire contents of this Liability Waiver and that I understand:

i)             The potential risks and dangers incidental to participating in lapidary activities;

ii)            That I am fully aware of the legal consequences of this Liability Waiver and that I understand I am waiving certain rights and assuming the risk of all injuries and damages arising from attending and participating in lapidary activities at the aforesaid lapidary workshop; and

iii)           That I agree to its terms and conditions.

Please note: Anyone attending and participating in lapidary activities at the aforesaid lapidary workshop, including parents/guardians accompanying minor children, who do not wish to accept the risks and dangers described in this Liability Waiver should not sign this document and will not be allowed to attend and participate in lapidary or class activities at the aforesaid lapidary workshop.
